One of the most infuriating things about the invasion of our southern border is how prosecutors and the Biden regime keep punishing Americans for it. If you defend yourself against any of the drug cartel assassins or child molesters that Joe Biden is letting in, you stand a good chance of going to prison. That was the nightmare scenario that a 75-year-old Arizona rancher named George Alan Kelly was facing. Prosecutors put the old man on trial for second-degree murder after an altercation with drug cartel criminals. Fortunately, a mistrial was declared in the case on Monday.

The case made national headlines when it happened in January 2023. It was the kind of case that liberal news media reporters lie awake at night and masturbate to while having sexual fantasies about the Pulitzer prizes they’ll win for covering it. A white property owner guns down a poor brown “unarmed migrant” who was just traveling to the United States to live out the American dream? It’s the story of the century!

That’s how the story has been portrayed in the mainstream media the entire time. But that’s not what happened at all.

On January 30, 2023, George Kelly’s elderly wife phoned their Border Patrol ranch liaison to report that men dressed in camouflage and carrying automatic rifles and backpacks were traipsing across their property. The Kellys own a 170-acre cattle ranch right next to the border near Keno Springs, Arizona.

The Border Patrol never showed up. A short time later, a group of illegal aliens had congregated about 100 yards away from the Kellys’ front door and was gesturing toward the house. One of them pointed a rifle directly at him. Fearing for the life of his elderly wife and himself, George Kelly stepped out on his front porch and fired nine warning shots over the heads of the group with an AK-47, according to his defense attorney. The illegals ran away.

When George Kelly walked out to where the group had been loitering later, he discovered a dead body on the ground and phoned the police. Prosecutors charged him with first-degree murder, second-degree murder, manslaughter, negligent homicide, and aggravated assault.

Contrary to the lie pushed by prosecutors and the liberal media, the dead man was not some random “unarmed migrant” with the cure to cancer in his pocket on his way to enriching the lives of Americans with more diversity. The body was that of Gabriel Cuen-Buitimea, a 48-year-old Mexican national. Cuen-Buitemea is a known drug cartel member who has been deported from the US multiple times.

“Long story short, this is simply not somebody who’s looking for the American dream,” said defense attorney Brenna Larkin. “There’s no evidence that this person is here for those kinds of benign purposes.”

The defense also argued that the elderly couple was alone and afraid on their isolated property. When they called the authorities for help, the authorities never arrived. Most of the members of the jury were convinced by those arguments.

The jury deliberated for part of last Thursday, and then all day on Friday and Monday. By the end of Monday afternoon, Larkin says that seven members of the jury were ready to vote not guilty on all charges. Only one person on the jury was leaning toward a guilty conviction. The judge declared a mistrial.

Prosecutors have until next week to announce whether they plan to put George Kelly on trial again. They’d need some new evidence against him to do that. Given the fact that the first jury was so unconvinced by the prosecution’s arguments, they should just let it go.
