Multistate Coalition Fights Biden ATF’s Attempt to Stop Firearm Sales Among Americans

By now, it’s been made quite clear that the political left has every intention of stripping America of her Second Amendment rights. Thankfully, multiple states are fighting back.

The latest attempt to take your guns or at least eliminate them has been made by the Biden administration’s Alcohol, Tobacco, and Firearms Department or ATF. As usual, they can’t come right out and ban guns, gun sales, etc. So, they have to be rather sneaky about it.

It’s called the 2022 Bipartisan Safer Communities Act, which made the slightest of changes to the definition of who can be considered a “gun dealer.” However, that “slight” change would have major repercussions.

Currently, the law says that a gun dealer is anyone who engages in repetitive gun, ammunition, or gun accessory sales with the “principal objective” of making a “livelihood or profit.”

Thanks to Biden’s June 25, 2022, signing of the bill into law, the “livelihood” portion of that definition is now gone.

So, according to the law, anyone who makes a profit from selling or trading a gun, even if it’s just once, can be classified as a gun dealer. And this means that they will need to buy an expensive and usually hard-to-acquire gun dealer license to do so. It also means they would need to run a “universal background check” on anyone receiving a gun from them, which is also expensive, not to mention intrusive.

Anyone who has sold or traded a firearm without one would become a criminal overnight – with that night beginning May 20.

I don’t know about you, but where I am from, selling and trading firearms is a pretty common occurrence. Someone needs some extra money, so they sell a gun. I have a gun that I no longer use, and my neighbor needs a new turkey gun. You need chicken feed, and your farmer friend needs a gun for his daughter to hunt with next deer season… a trade is made.

The list goes on and on.

In fact, almost everyone I know has bought, sold, or traded a weapon in this manner. There’s no danger or harm in it, and up until now, it’s been completely legal.

But suddenly, all of those people could now face being arrested, prosecuted, and jail time or serious fines for doing nothing more than selling a single gun to a law-abiding family member or friend.

Thankfully, as I mentioned before, people are willing to fight this.

Kansas Attorney General Kris Kobach is one.

He, along with 21 other state AGs, have filed a suit against Biden’s administration and his ATF. According to the suit, “This rule is blatantly unconstitutional. We are suing to defend the Second Amendment rights of all Americans.”

AGs from Alabama, Alaska, Arkansas, Georgia, Indiana, Idaho, Iowa, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia, and Wyoming have joined Kobach.

Another example is Texas Attorney General Ken Paxton, who has also filed a suit against the law and Biden’s administration. “The ATF’s regulatory restrictions go beyond the authority granted to the agency by Congress. The new Final Rule is arbitrary and capricious and is a flagrant violation of the Second Amendment.

Twenty-five other states, so over half of the US, have joined Paxton’s suit, including Utah and Mississippi.

It’s high time Biden and his Second Amendment eliminating attempts were stopped.
